Welcome to Merchy. The terms “we”, “us”, and “our” refer to Merchy. We operate this website and store, including related information, content, features, tools, products, and services (the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”) together with the policies referenced here describe your rights and responsibilities when you use the Services. By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy and Return & Refund Policy. If you do not agree, do not use or access the Services.

When you place an order, you make an offer to purchase. We may accept or decline any order at our discretion. Your order is accepted only when we confirm it after successfully receiving and processing payment. Please review your order carefully before submission; after acceptance we may be unable to cancel. If we decline or cancel, we will attempt to notify you using the contact details you provided. Purchases are for personal/household use and not for commercial resale or export. Returns/replacements are governed solely by our Return & Refund Policy.

Prices, discounts, and promotions may change without notice. The price charged is the price in effect at checkout and shown in your order confirmation. Unless expressly stated, prices exclude taxes, shipping, handling, and any government charges. Prices on our website may differ from those in any third-party or physical stores. Promotions may have additional terms; if there is a conflict, the promotion terms govern. You agree to provide current, complete, and accurate purchase and payment information and to promptly update it as needed. You represent and warrant that you are authorised to use the payment method and that charges will be honoured, including applicable taxes and fees.

5. Shipping and Delivery

The Services (including text, graphics, images, video, audio, design, and arrangement) are owned by Merchy, our affiliates, or licensors, and are protected by Indian and international intellectual property laws. You may use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works of, publicly display, perform, republish, download, store, or transmit material from the Services without our prior written consent.

Trademarks: “Merchy”, our logos, and associated names are our trademarks. Shopify’s names and marks are trademarks of Shopify. Other names and logos on the Services are the property of their respective owners.

Unofficial merchandise notice: We sell unofficial fan-inspired merchandise and posters. Third-party names, logos, or references (including memes, events, or races) are used descriptively and do not imply endorsement or affiliation. You agree not to upload or request designs that infringe third-party rights.

7. Optional Tools and New Features

We may provide access to tools or features offered by third parties on an “as-is” and “as-available” basis without warranties or endorsements. Your use is at your own risk and subject to the relevant third party’s terms. New features released in the future form part of the Services and are subject to these Terms.

We are not responsible for examining or evaluating such content or its accuracy and are not liable for any harm or losses arising from your use of third-party sites. 9. Relationship with Shopify

Our store runs on Shopify. Sales are made by Merchy, not by Shopify. Shopify is not responsible for our sales, products, warranties, customer service, or any injury, damage, or loss arising from your purchases. You expressly release Shopify and its affiliates from claims related to your transactions with Merchy.

10. Privacy

Personal information collected through the Services is subject to our Privacy Policy and certain data may also be processed under Shopify’s Privacy Policy to operate the platform. Because the Services are hosted by Shopify, information you submit may be processed in countries outside India to provide and improve the Services. See our Privacy Policy for details.

11. Feedback

If you submit ideas, suggestions, reviews, proposals, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display the Feedback for any purpose. You represent that you own or control the rights to your Feedback and that it complies with these Terms and applicable law. We may monitor, edit, or remove Feedback in our discretion.

12. Errors, Inaccuracies, and Omissions

The Services and all products are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that content will be accurate or reliable. Your use is at your sole risk. 16. Limitation of Liability

To the fullest extent permitted by law, Merchy, Shopify, and our respective directors, officers, employees, affiliates, agents, contractors, service providers, and licensors will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or loss of profits, revenue, savings, data, or business opportunities, arising out of or related to your use of the Services or products, even if advised of the possibility. Our aggregate liability for direct damages will not exceed the amount you paid for the product that gave rise to the claim.

You agree to indemnify, defend, and hold harmless Merchy, Shopify, and our respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, violation of law or third-party rights, or misuse of the Services. We may control the defence at your expense and you will reasonably cooperate.

If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted and the remainder will continue in full force.

19. Waiver; Entire Agreement

Our failure to enforce any provision is not a waiver. These Terms and any policies posted on the website constitute the entire agreement between you and us regarding the Services and supersede prior agreements or communications.

These Terms are governed by the laws of India. You and Merchy agree to the exclusive jurisdiction of the courts at Agra, Uttar Pradesh, India for any disputes arising out of or related to the Services, subject to applicable law.
